These Terms and Conditions (“Terms”) govern your access to and use of vayeraperfumes.com and related pages (the “Website”), including browsing, creating an account, and placing orders through our online store.

Vayera Fragrance Co. (“Vayera”, “we”, “our”, “us”) operates the Website. By accessing the Website, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Cookie Policy (where published on the Website). If you do not agree, please do not use the Website or place an order.

2. Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not:

  • Misuse, disrupt, or attempt unauthorised access to the Website, our systems, or third-party services connected to it
  • Place fraudulent, false, or duplicate orders
  • Provide false or misleading registration, delivery, or payment information
  • Interfere with other users’ use of the Website
  • Copy, scrape, harvest, or commercially exploit Website content without our written permission
  • Use the Website in violation of applicable law

We may suspend or restrict access to the Website or to an account if we reasonably believe these Terms have been breached or if necessary to protect the Website, our customers, or our business.

You are responsible for keeping your account login details confidential and for activity under your account.

3. Sales territory and eligibility

We currently sell and deliver only within India.

  • You must be 18 years of age or older to purchase from the Website
  • Delivery addresses must be valid Indian addresses
  • We do not offer international shipping or sales outside India at this time

The Website may be accessible from other countries, but that does not mean we offer international sale, delivery, or support. We may refuse, cancel, or refund orders placed for delivery outside India, that appear intended for export or unauthorised resale, or that we cannot fulfil for legal, operational, or fraud-prevention reasons.

4. Product information and imagery

We aim to ensure that product names, descriptions, sizes, prices, and other information on the Website are accurate and current. However:

  • Minor variations in packaging, labelling, batch, or appearance may occur
  • Fragrance descriptions are illustrative; scent perception is subjective
  • Colours and appearance may vary slightly depending on your screen or device

Product imagery: Product photographs on the Website represent our actual products. We may use digital or AI-assisted tools to refine presentation (for example, lighting, colour balance, or background). These enhancements are for display purposes only and are not intended to misrepresent the product you receive.

If a product you receive materially differs from what you ordered, contact us promptly using the details in Section 16.

5. Pricing, taxes, and availability

  • Prices are displayed in Indian Rupees (INR / ₹)
  • GST: Prices shown at checkout include applicable GST at the rates in force at the time of purchase. The GST amount and total payable are displayed at checkout and match the tax breakdown on your order confirmation and tax invoice
  • Prices, offers, and product availability may change at any time before you complete checkout
  • The price and availability shown at the time you complete payment apply to your order, subject to confirmation
  • We may cancel an order if a product is unavailable, if there is a pricing or system error, or if we are unable to verify or process the order

Promotional codes, discounts, or offers are valid only as stated on the Website or in our communications, may be subject to conditions, and may be withdrawn or modified at any time.

6. Orders and contract formation

When you place an order on the Website:

  1. Your order is an offer to purchase the selected products on these Terms
  2. A contract is formed when we accept your order — typically when payment is successfully authorised/captured and we send an order confirmation by email or display confirmation on the Website
  3. If we cannot accept your order (for example, due to stock, payment failure, suspected fraud, or an error), we will notify you and any amount charged will be handled in accordance with Section 10

Please check your order confirmation and tax invoice carefully. They contain the details that govern your purchase.

We reserve the right to limit quantities, refuse orders, or cancel orders at our reasonable discretion, including where we suspect fraud, abuse, or violation of these Terms.

7. Payment

Payments on the Website are processed by our payment partner, Razorpay, using methods they support (such as credit/debit cards, UPI, net banking, wallets, or other options shown at checkout).

  • By placing an order, you authorise Vayera Fragrance Co. and our payment provider to charge the total amount shown at checkout
  • We do not store your full card, UPI, or net banking credentials on our servers
  • If payment is not completed successfully, your order will not be confirmed
  • Payment processing is subject to Razorpay’s terms, security standards, and privacy policy

8. Shipping and delivery

Vayera Fragrance Co. arranges delivery of orders within India using our logistics partners, including Shiprocket and assigned courier services.

  • Delivery timeframes shown on the Website or in communications are estimates only, not guarantees
  • You must provide a complete and accurate delivery name, address, phone number, and PIN code
  • You are responsible for ensuring someone is available to receive the delivery where required
  • Title to and risk in the products generally pass to you upon delivery to the address you provided, unless otherwise required by applicable law

If delivery fails due to incorrect address details, refusal of delivery, or repeated failed attempts, we may cancel the order or charge additional delivery costs where permitted by law and these Terms.

9. Cancellations

By you: You may request cancellation only before your order has been dispatched by emailing contact@vayeraperfumes.com with your order number. Once an order has been dispatched, it cannot be cancelled.

By us: We may cancel an order if the product is unavailable, payment fails or is reversed, we suspect fraud or abuse, the order cannot be delivered, or we are required to do so by law. If we cancel after payment, we will refund the amount paid in accordance with Section 10.

10. Returns, refunds, and replacements

All sales are final. We do not accept returns, exchanges, or replacements once an order has been dispatched, including for reasons such as change of mind, scent preference, or ordering the wrong product.

By completing a purchase, you acknowledge and agree that:

  • Fragrance products are personal-use items and cannot be returned after dispatch
  • You have reviewed your order (product, size, quantity, and delivery details) before payment

Order cancellation before dispatch: If you cancel before dispatch (Section 9), we will refund the amount paid to the original payment method within 7–14 business days, subject to your bank, card issuer, or Razorpay processing times.

Cancellation or refund by us: If we cancel your order or are required to refund you (for example, due to non-availability or a payment error), we will refund the amount paid to the original payment method within 7–14 business days, subject to third-party processing times.

Defective, damaged, or incorrect products: If you believe you received a defective, damaged-in-transit, or incorrect product, contact us within 48 hours of delivery at contact@vayeraperfumes.com with your order number and clear photos. We will review the matter. This does not guarantee a return or refund except where Vayera Fragrance Co. is required to provide a remedy under applicable consumer protection law in India.

Shipping charges are non-refundable except where we cancel the order or a refund is required by applicable law.

11. Promotional communications

If you opt in to marketing emails or other promotional communications, you may unsubscribe at any time using the link in our emails or by contacting us. Transactional messages (such as order confirmations, tax invoices, and shipping updates) are not marketing messages and may still be sent as needed to fulfil your order.

12. Intellectual property

All content on the Website — including text, images, product photography, logos, branding, design, and layout — is owned by or licensed to Vayera Fragrance Co. and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit Website content for commercial purposes without our prior written consent.

13. Third-party services

The Website and order process rely on third-party service providers, including:

  • Razorpay (payments)
  • Shiprocket and courier partners (shipping and tracking)
  • Hosting, email, analytics, and other operational providers

Their services are subject to their own terms, policies, and technical requirements. Vayera Fragrance Co. is not responsible for delays, failures, or acts or omissions of third-party providers beyond our reasonable control, except as required by applicable law.

We do not control how third-party providers operate their internal systems, including any automated or AI-assisted tools they may use. Their handling of information is governed by their own privacy policies and our agreements with them, as described in our Privacy Policy.

Links on the Website to third-party sites are provided for convenience. We are not responsible for the content or practices of those sites.

14. Limitation of liability

To the fullest extent permitted by applicable law:

  • The Website and its content are provided on an “as is” and “as available” basis
  • We do not guarantee uninterrupted or error-free operation of the Website
  • Vayera Fragrance Co. is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or any order, including loss of profit, data, or goodwill
  • Our total liability for any claim relating to a specific order is limited to the amount you paid for that order, except where a higher liability cannot be excluded under applicable law (including applicable consumer protection law in India)

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15. Privacy

Your use of the Website and any order you place is also governed by our Privacy Policy, which explains how Vayera Fragrance Co. collects, uses, stores, and shares personal data, including data shared with Razorpay, Shiprocket, and other service providers.

16. Changes to these Terms

We may update these Terms from time to time. The Effective date at the top will change when we do. Material changes will be posted on this page.

Continued use of the Website after changes are posted constitutes acceptance of the updated Terms where permitted by law. If you do not agree to updated Terms, you should stop using the Website.

17. Governing law and jurisdiction

These Terms are governed by the laws of India.

Any dispute arising out of or relating to these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts in India, without prejudice to your rights under applicable consumer protection laws.
